With these Conditions of Sale, Oliocentrica Srls wants to inform the user of the rights deriving from this relationship with reference to:
Consumer Code, in particular from Part III, Title III, Chapter I of “Consumer rights in contracts”, Sections I to IV (Number 45 to 67).

The user is required, before accessing the products provided by the site, to read these Conditions of Sale which are generally and unequivocally accepted at the conclusion of the purchase.
In the event that the user does not agree with the content of these Conditions of Sale, we invite him to cease using the site.

Oliocentrica Srls may make changes to the Conditions of Sale at any time, subject to the conditions for purchases already concluded, with the obligation to make them viewable on the Site.

Article 3 – Registered users

Access to the Site, browsing and purchasing one or more products in the online Shop do not require the user to register.
However, Oliocentrica Srls provides for the creation of an account, by registration, to facilitate customers in purchasing operations and to make the best use of the services offered. The user will be able to view his recent orders, manage his shipping and billing addresses, and change his password and account details. In completing the registration procedures, the user undertakes to follow the instructions on the site and to provide their personal data correctly and truthfully. Oliocentrica Srls, to build and consolidate relationships with its customers, provides a free Newsletter service through which it undertakes to send updates, publication of articles, promotions and everything that it deems of commercial interest.

Article 5 – Products offered

Oliocentrica Srls markets products and services related to the Italian olive and gastronomic sector. The selection takes place directly, without the use of sales representatives.
Each product is related with photos, description and information sheet. The images of the products are for demonstration and illustrative purposes.
Oliocentrica Srls employs the best professionals in the sector in order to provide truthful images of the products. However, there may be discrepancies between the images published in the online shop and the actual product, in terms of dimensions, chromatic aspects and other characteristics of the product itself. In case of differences between images and product sheets, the description of the product sheet prevails.

Article 6 – Prices

Product prices are expressed in Euros and include VAT.
They do not include shipping costs, duties and surcharges applicable in the territory of destination of the products, which are charged to the customer, and summarized under the heading “shipping” before concluding the purchase and may be subject to changes at any time, which are not applied to confirmed and paid purchases.
Each product has evidence of the price, offers and promotions will be easily identifiable.

Article 7 – Purchase of products

The forwarding of the order constitutes the purchase proposal addressed by the customer to Oliocentrica Srls. The customer will receive an e-mail confirming receipt of the order containing a general summary of his purchase. The order receipt confirmation will also contain the customer’s data who is required to check its correctness and, if necessary, to request its timely correction. Oliocentrica Srls reserves the right not to accept, even partially, the purchase orders received.
The Customer registered on this site, by accessing his personal area with the login credentials, will be able to view his orders.

Article 8 – Methods of payment

The order will be processed only upon actual receipt of the amounts in the Oliocentrica Srls current account. If these amounts are not received within 7 working days from the time of purchase, the order will be considered canceled.

2. PayPal and Credit Cards

Article 9 – Shipping

Shipping costs are charged to the customer and are calculated based on the total weight of the products purchased, they are expressly indicated in the final phase of the purchase, before payment.

Free shipping for Italy
Free shipping is provided for purchases over 99 euros. In this way you will have the advantage of quickly receiving what you need without charging shipping costs.
For Livigno, Venice and the smaller islands, free shipping is provided for purchases over 299 euros.

Free shipping for Europe
Free shipping is provided for purchases over € 399 for the following countries: Austria, Belgium, Croatia, Denmark, France, Finland, Germany, Ireland, Liechtenstein, Luxembourg, Netherlands, Poland, Czech Republic, Slovenia, Spain, Hungary .
Free shipping is provided for purchases over 499 euros for the following countries: Bulgaria, Estonia, Latvia, Lithuania, Portugal, Romania, Slovakia, Sweden.
Free shipping is provided for purchases over 599 euros for Switzerland and over 699 euros for Malta.

We entrust our shipments to the best couriers on the national territory guaranteeing delivery in 1/2 working days from the moment the package is collected from our warehouses.
All our shipments provide for the “tracking” of the state. A series of email alerts are sent directly to the customer who will be promptly informed of the status of his shipment.

Most of our products have immediate availability and are delivered to the courier within 24 working hours from the order. The other products are however normally shipped between 5 and 9 working days.
The timing could be lengthened for the islands, disadvantaged areas, periods of particular intensity and unexpected events of the courier during delivery.

Article 10 – Delivery of products

Deliveries will be made to the address indicated by the customer on working days and hours.
Upon delivery of the products by the courier, the customer is required to verify that the number of packages corresponds to what is indicated in the accompanying document and that the packaging is intact. Any damage to the package and / or products or the mismatch in the number of packages must be immediately notified by means of a written check on the courier’s proof of delivery. Once the courier’s document has been signed, the customer will not be able to make any objection about the external characteristics of the package delivered.
Oliocentrica Srls cannot be held responsible for errors in delivery due to inaccuracies or incompleteness in the compilation of the purchase order by the customer, nor for any damage to the products after delivery.
In case of non-delivery due to the absence of the recipient, the products will be returned to Oliocentrica Srls, which will contact the customer to arrange a new delivery, remaining the customer’s responsibility for the additional delivery costs.
If the delivery cannot take place for reasons not attributable to Oliocentrica Srls after thirty days from the date on which the order is available for delivery, the purchase will be considered void.
As a result of the resolution of the failed purchase, the amounts will be returned, including delivery costs with the exclusion of any additional costs deriving from the choice of a delivery method other than the ordinary method offered, without undue delay and, in any case, within 15 days from the date of termination of the non-purchase. The transport resulting from the resolution of the non-purchase could have additional costs that will be borne by the buyer.

Article 11 – Passing of risk

The risks relating to the products will pass to the buyer from the moment of delivery.
Since these are food products, even if packaged and not subject to refrigerated storage, the organoleptic characteristics, quality and duration of each product are strictly linked to the method of conservation of the same.
Oliocentrica Srls invites the customer to observe the conservation rules described in the sheet of each product purchased.
The opening of the guarantee seal, the proven non-compliance with the conservation rules or the use of part of the product will void the application of the guarantee and commercial compliance.

Article 12 – Warranty and commercial compliance

Oliocentrica Srls is responsible for any defect in the products offered on this site, including the non-conformity of the products ordered, in accordance with the provisions of Italian law.
The Customer who purchases as a consumer has the right to guarantee 24 months from the purchase on products that show conformity defects according to the conditions established by law and provided that Oliocentrica Srls is notified of the defects found, in the same manner provided. to exercise the right of withdrawal, within 2 months of their discovery.
To exercise the right of guarantee, the Consumer, in addition to having complied with what is indicated in point 11 “passage of risk”, is required to return the product intact, in its original packaging, accompanied by the invoice or other accompanying documentation.
Oliocentrica will replace the product with an identical one or, in case of exhaustion, with one of equivalent commercial value.
The costs of returning the objected product remain the responsibility of the consumer, while those of shipping the replacement product remain the responsibility of Oliocentrica Srls.

Article 13 – Right of withdrawal

In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within the period of 14 days pursuant to art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products.
In the case of multiple purchases made by the buyer with a single order and delivered separately, the 14-day term starts from the date of receipt of the last product.
To exercise the right of withdrawal, the buyer is required to inform Oliocentrica Srls of his decision to withdraw from the purchase by means of an explicit declaration to be sent by ordinary mail or by email, indicating the order number, his data and the reason for the withdrawal, to the following address:

To meet the withdrawal deadline, it is sufficient for the buyer to send the communication relating to the exercise of the right of withdrawal before the withdrawal period expires (14 days).
If the buyer withdraws from the purchase, he will be reimbursed for all payments he has made to Oliocentrica Srls, including delivery costs, with the exception of additional costs deriving from a possible choice of a type of delivery other than that offered by Oliocentrica Srls, without undue delay and in any case no later than 14 days from the day on which Oliocentrica Srls was informed of the buyer’s decision to withdraw from the purchase. These refunds will be made using the same payment method used by the buyer for the initial transaction, unless the buyer has expressly agreed otherwise; in any case, the buyer will not have to incur any costs as a result of this reimbursement. In the case of payment made by bank transfer, the buyer must provide the bank details: IBAN, SWIFT and BIC necessary for the refund.
The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, Oliocentrica Srls will refund the amount of the purchase subject to withdrawal within a maximum period of 15 days.
As required by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, Oliocentrica Srls may suspend the reimbursement until receipt of the goods or until the buyer demonstrates that he has returned the goods.
The right of withdrawal will not apply in the event that the services and products of Oliocentrica Srls are included in the categories of Article 59 of Legislative Decree 206/2005.

Article 14 – Safeguard clause

In the event that one of the clauses of these Conditions of Sale is void for any reason whatsoever, this will in no case compromise the validity and compliance with the other provisions contained in these Conditions of Sale.

Article 15 – Applicable law and competent court

These Conditions of Sale are governed by Italian law and interpreted on the basis of it, without prejudice to any other prevailing imperative rule of the buyer’s country of habitual residence. Consequently, the interpretation, execution and termination of the Conditions of Sale are subject exclusively to Italian law.
Any disputes inherent and / or consequent to the same must be resolved exclusively by the Italian judicial authority. In particular, if the user qualifies as a consumer, any disputes must be resolved by the court of the place of domicile or residence of the same according to the applicable law.

Article 18 – Suspension of the service

Oliocentrica Srls reserves the right to suspend or interrupt the service, both temporarily and definitively, without the need for prior notice; it is also the right of Oliocentrica Srls to modify the functionality and characteristics of this site and of the service.
